Privacy Notice

At Food Brokers we want our partners, both the buyers and the sellers of our platform, to know and have control over what data they share with us and what we do with them. This text (called Privacy Policy) explains in a simple but also clear manner what data we collect about you in the context of our collaboration and how we use them. It is underlined that this policy is addressed only to the partners (buyers or/and sellers) who are natural persons or their representatives [hereinafter "Partners"], but also generally to any interested visitors of the platform, since the applicable legislation [Regulation (EU) 2016/679, Greek Law 4624/2019, Greek Law 2472/1997] recognizes the meaning of personal data and the respective protection only for natural persons.
Data Controller
The company "FoodBrokers Single Member Société Anonyme" [hereinafter "FB" or "us"] located at 40 Eleftherias Square and Averoff, PC 712 01 Heraklion Crete, is in accordance with the law the data controller for the processing of personal data of the Partners and in general of the visitors of the website https://www.foodbrokers.com  [hereinafter the "Digital Platform"], in the context of providing intermediary services in buying and selling food and related products through an electronic wholesale shopping platform [hereinafter "FB Services"]. Specifically, these services include the display, promotion and facilitation of the marketing products of each seller through the Digital Platform to the buyers, in accordance with the applicable contractual obligations governing the FB Services. In addition, they may include support services, such as logistics, organization of exports and certifications.

Personal Data We Collect
As part of the admission of a new Partner, but also generally in the context of providing the FB Services, we collect and further process your personal data, depending on the FB Services you use:
  • Identification information, such as company name, name of representative, e-mail, username, password and date of registration, Tax Registration Number and Tax Office, Chamber of Commerce registration number
  • Other details relating to requirements of checking the accuracy and verifying customer’s identity (“Know Your Customer”), on behalf of the appointed payment services provider.
  • Contact details, such as other email addresses, full postal address, landline and mobile phone number
  • Banking account details, such as account number, IBAN, holder’s name
  • Result of the evaluation of the cooperation application and content of the relevant communications
  • Area of ​​business activity and type of cooperation based on the used FB Services (e.g. Basic, Gold, Platinum, VIP)
  • Additional information regarding the documentation and clearing of transactions between us and/or transactions between Partners through the Digital Platform, such as payment details (date, amount, balance, price category, turnover, VAT), number and beneficiary of bank account, card details
  • Communications between Partners in the context of finalizing the details of an order, through the special contact form or the special chatbox provided on the Digital Platform
  • Information we receive when you tell us your opinion or ask for support for FB Services, such as reviews or responses to reviews, satisfaction surveys, and your comments or suggestions in order to ameliorate our services
  • Evidence of suspicious incidents or transactions
  • Information that we collect through technological solutions such as cookies, or the use of local storage space, regarding your interaction with the Digital Platform or our application for mobile devices, e.g. information on usage statistics of FB Services, favorite or comparable products, logins, etc. In addition, we process data related to the management and resolution of technical errors and security of navigation and transactions related to the provision of FB Services, as well as device connection details, such as IP address, type and manufacturer of your used device, browser type, type and version of the operating system or application.

Why we collect it
The above personal data is processed by us exclusively for the following purposes and in accordance with the following lawful bases:
Contract
FB processes your data in order to evaluate the possibility of cooperating with you, but also for the execution of the contractual relationship with you, after the beginning of the cooperation.
Specifically, we process your information in order to provide the FB Services you use and in particular to create a new Partner account, access and manage your profile on the Digital Platform, as well as other technical solutions for reviewing data analysis and clearing transactions. We also process your information for submitting and managing your queries or requests (such as providing technical guidance or making changes to your information), for submitting and processing reviews on the Digital Platform or responses to them, for providing general service and support, for the calculation, monitoring and clearing of pricing for the use of FB Services, for the provision of additional possible services, such as logistics, organization of exports and certifications and for the management of any potential termination or suspension of our cooperation.
Legitimate interests
It is in FB's legitimate interest to carry out audits of its prospective and active Partners to prevent fraudulent transactions and to identify suspected violations of applicable law (e.g. tax) or malicious use of FB Services, which may harm the FB’s financial interests or/and reputation.
In addition, it is in FB's legitimate interest to ensure the smooth operation and security of its systems and to send satisfaction surveys and other commercial/promotional communication (e.g. for FB news).
Furthermore, we have a legitimate interest in processing Partners’ data for the defense and exercise of our legal claims, but also for the general legal monitoring of our cooperation.
Finally, to the extent that we have undertaken such an obligation on a case-by-case basis, we have a legitimate interest to ensure that the transactions made via our Digital Platform are secure and reliable, and to support the Partners in proving, establishing and resolving any disputes between them. In this context, it is underlined to our Partners that the conversations they make through the special contact form or the special chatbox provided on the Digital Platform are not confidential between the buyer and the seller, but they can be monitored at any time by FB in order to verify if the terms of use of the FB Services are met, but also to prove what has been agreed in the respective transaction.
Legal obligation
FB is obliged by law to cooperate with the competent authorities, in particular at their request, for combating specific incidents concerning in particular transactions between Partners made through the Digital Platform and which are suspected of violating the provisions of the law. We are also required by law to manage and respond to your requests regarding the protection of your personal data.
Consent
By giving your consent to the use of technologies such as cookies and local storage on your device, information about you is automatically collected, in accordance with the FB Cookies Policy. You can change your choice of cookies at any time and withdraw your consent at the bottom of the FB Cookies Policy.
With whom we share it
Your personal data is collected and further processed by the authorized FB team, with full respect to your privacy. In the context of providing the FB Services, the following categories of our partners may be the recipients of your personal data:
  • Digital Platform analytics and performance service providers such as Google and data storage service providers such as Microsoft. Your data may be transferred outside of the EEA and especially in the USA by these companies.
  • Payment service providers and financial institutions.
  • Partners, in the context of processing orders through the Digital Platform, resolving a dispute or query.
  • Collaborating companies for storage and transportation of products (logistics).
  • Collaborating companies providing support services for the management and organization of product exports.
  • Collaborating companies providing certification support services (quality control & audits).
  • Collaborating communication and advertising companies, in the context of managing our communication with you.
  • Providers of software services, data storage and analytics, business strategists and providers of other administrative services.
  • External consultants, accountants and lawyers.
  • The police authorities and any other administrative, judicial or public authority or generally a legal or natural person to whom, by law or judicial decision, an obligation or a right may derive on behalf of FB to disclose such information.
Please remember that both the submitted reviews and the answers to them are displayed publicly on the Digital Platform. In addition, the company name and the area of its establishment are also published on the Digital Platform.
How long we retain it
FB retains the personal data of its Partners for as long as the cooperation is in force. Personal data is retained for an additional five (5) years after the end of the cooperation in any way, especially for tax purposes.
After the end of this period and in the event that no financial obligation, legal or other dispute or special legitimate interest arising from the use of the FB Services is pending, the data will be deleted or anonymized.
Our Commitment
We implement the adequate technical and organizational measures on a daily basis, according to the latest technological standards and applicable, in order to ensure that the processing of personal data, either by us or by third parties on our behalf, is legitimate, appropriate and has the proper security level to prevent any unauthorized or accidental access, processing, deletion/erasure, alteration or other use thereof.
Your Rights
You can access, rectify and/or delete your data at any time through your profile settings on the Digital Platform or by sending us a relevant request.
In general, according to applicable personal data protection legislation, following verification of your identity, you have and may exercise the following rights:
the right of access, i.e. the right to be informed about whether your personal data is being processed by FB and receive further information concerning the processing undertaken,
the right to rectification of any inaccurate personal data of yours or the completion thereof (e.g.  rectification of Tax Registration Number),
as well as and provided that the legal requirements are met:
the right to erasure,
the right to data portability, i.e. the right to receive and transfer to another data controller your personal data, which you have provided to the FB, in an adequate format,
the right to restriction of the processing,
the right to object, in particular to processing operations based on our legitimate interests, such as the sending of a commercial/promotional communication
the right to withdraw at any time the consent you have given us, without such withdrawal affecting the lawfulness of personal data processing having already taken place before its withdrawal.
In case of exercising the rights to rectification, erasure and restriction of processing of your data, these requests will be forwarded to the third party recipients to whom this data may have been disclosed by us, in the context of providing the FB Services.
The exercise of the aforementioned rights takes place by submitting a relevant written request to the FB, to which we commit to answer within one (1) month following its reception. This period may be extended for two (2) additional months due to the complexity of the request, or/and the total number of requests received.
